These Terms and Conditions ("Terms") apply when you use durbanwebdesigners.co.za (the "Website") and when you order web design services from NetAmplified ("we", "us", "our"). Please read them before you order. In these Terms, "you" means the person or business ordering from us.
1. Your legal rights
If you are a consumer under the Consumer Protection Act 68 of 2008 ("CPA") or the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), nothing in these Terms limits the rights those laws give you, including any cooling-off right that applies to you. If any part of these Terms conflicts with those laws, the law applies.

3. What the package includes
Our Professional Business Website package includes:
- a custom-designed website of up to 5 pages;
- a mobile-responsive layout;
- WhatsApp integration and a contact/enquiry form;
- basic on-page SEO;
- Google Analytics and Search Console setup; and
- assistance with setting up hosting and your domain name.
Not included unless we agree otherwise in writing: hosting and domain registration fees, writing your content, photography, logo or brand design, paid plugins, themes or stock images, additional pages, advertising, ongoing SEO, and ongoing maintenance. If you need more than 5 pages, we will quote the difference before doing the extra work.
4. Price and payment
- The package price is R4,500, once-off, in South African rand. Not VAT-registered, so no VAT is charged. There are no other fees for the package itself.
- We begin work once we receive a deposit of 50%. The balance is payable before the website goes live.
- Payment is by EFT. We will email or WhatsApp you an invoice with our banking details. Please do not pay into any account we have not confirmed with you directly.
- If an invoice is overdue, we may pause work until it is paid.
5. How an agreement is formed
An enquiry on the Website is not an order. After you contact us, we will confirm the scope, price and estimated timeline in writing (by email or WhatsApp). The agreement between us starts when you accept that confirmation in writing and pay the deposit. You can accept electronically, and an electronic acceptance is as binding as a signed one.
6. What we need from you
- The text, images, logos and other content for your website, in good time.
- Prompt feedback and approvals when we ask for them.
- Confirmation that you own, or have permission to use, everything you give us (including images, fonts and text), and that it does not break anyone's rights or any law.
You are responsible for the accuracy and legality of your own content, including claims you make about your business.
7. Timeline
We aim to complete the website within 7 to 14 working days after we receive your deposit and all the content we need. This is an estimate, not a guarantee. Delays in receiving content or feedback from you extend the timeline. To the extent the law allows, the timeline in our written confirmation applies instead of any default performance period.
8. Revisions and changes
The package includes 2 rounds of revisions to the design and content we agreed on. Changes outside the agreed scope, such as new pages, new features or a different design direction, are quoted separately and need your approval before we start.
9. Hosting, domain and third-party services
Your domain name and hosting account should be registered in your name. We help you set them up, but the fees (such as annual hosting and domain renewals) are paid by you directly to the provider and are not part of the package price. Third-party services (hosting, domain registrars, email, plugins, Google, WhatsApp and similar) are governed by their own terms, and we are not responsible for their outages, price changes or policies.
10. Launch and acceptance
Before launch, we will give you a chance to review the website. Once you approve it, or use it live, the website is treated as accepted, subject to section 11.
11. After launch
For 14 days after launch, we will fix, at no charge, errors in our work that stop the website working as agreed. After that, and for changes, updates, security maintenance or content edits, we can agree a separate fee.
12. Intellectual property
- When we have received full payment, we assign to you ownership of the custom design and original content we create specifically for your website.
- We keep ownership of our pre-existing tools, code, templates and know-how, and you may use them as part of your website without time limit.
- Open-source and third-party software (for example WordPress and plugins) stays under its own licence.
- We may show your website in our portfolio and marketing, with a link to it, unless you tell us in writing before launch that you prefer us not to.
13. No guarantee of results
A professional website makes it easier for customers to find and contact you, but we do not guarantee search engine rankings, website traffic, enquiries, sales or any other business result. Those depend on factors outside our control, such as your market, your offer, competition and any advertising you run.
14. Cancellation and refunds
- If you cancel before we start work: we refund your deposit in full.
- If you cancel after we have started: you pay for the work done up to the date of cancellation, calculated fairly against the package price, and we refund any balance of your deposit that exceeds that amount. We hand over the work completed to date once you have paid for it.
- If we cancel (for example, because we cannot complete the work), we refund anything you have paid for work we did not deliver.
- Refunds are paid within 30 days of cancellation, to the account you paid from.
- If our work does not meet what we agreed, we will first put it right as set out in section 11. This does not limit your statutory rights.
15. Our liability
To the extent the law allows:
- we are not liable for indirect or consequential loss, such as lost profit, lost business or lost opportunities;
- our total liability for any claim relating to our services is limited to the amount you paid us for the services the claim relates to; and
- you agree to cover our reasonable losses if the content you supply infringes someone else's rights.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, or anything the law does not allow us to exclude.
16. Confidentiality and privacy
We keep non-public information about your business confidential and use it only to provide the services. We handle personal information as described in our Privacy Policy. If your new website collects personal information from your own customers, you are responsible for having your own privacy notice and for complying with POPIA.
17. Using this Website
You may use the Website for lawful purposes only. The content, design and branding on the Website belong to us or our licensors, and you may not copy or reuse them without our permission. We try to keep the Website accurate and available, but we do not promise that it will always be error-free or uninterrupted. Links to other websites are provided for convenience and we are not responsible for their content.
18. Events beyond our control
Neither of us is responsible for delay or failure caused by events beyond our reasonable control, such as power outages (including load-shedding), internet or hosting outages, illness, natural disasters, or government action. We will tell you promptly if this affects your project.
19. Complaints, disputes and governing law
If you have a complaint, please contact us first so we can try to resolve it. If we cannot, you may approach the National Consumer Commission or any other body with jurisdiction over your complaint. These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
20. General
- Whole agreement: these Terms and our written confirmation are the entire agreement between us. If they conflict, the written confirmation applies to the specific project.
- Changes: we may update these Terms. The version in force when we confirm your order applies to that order.
- Notices: we may send notices by email or WhatsApp to the contact details you gave us, and you may do the same to ours.
- If part is unenforceable: the rest of these Terms continues to apply.
- No waiver: if we do not enforce a right straight away, we do not lose it.
